Motorcycle DUI Penalties

I haven't written about the very important subject of driving under the influence (DUI) in a few years, but it is important to keep this subject in front of riders. Given that riding season is finally in bloom, I want to touch on the topic of DWI/DUI as many riders will end up at destinations where alcohol is being served.   I want to inform all of you that the penalties for DUI/DWI are getting harsher and more expensive every year in Pennsylvania, and across the nation. Though I have written on this in the past, the legal blood alcohol content (BAC) limit merits renewed discussion. The .08 blood alcohol content limit to drive in Pennsylvania means that just two beers (or drinks) in rapid succession will put us close to the limit, especially if not ingested with food. Merry Holiday Season from the Cycle Attorney

For my last column of the year I am simply going to wish everyone a very merry holiday season, and a happy and healthy new year! Ride safe and remember Murphy's Law; if it can go wrong, it usually will.  So keep your head on a swivel, use caution at intersections, watch out for vehicles turning left in front of you, and don’t pass other vehicles on the right.  For those of you looking for a better insurance rate... if you have State Farm for your automobiles, use them to insure your bike. It may cost a little more but they are the only major insurance company that allows you to stack your bike coverage on to your automobile coverage.  If you do use State Farm, always choose the stacking option and purchase the same coverage on all vehicles and motorcycles. Purchase as Much … [Read more...]

Motorcycle Accident Injury Attorney: The Most Important Advice

What is the most important thing your Pennsylvania motorcycle accident injury attorney can tell you? Clients and potential clients, in all my experience as a motorcycle accident injury attorney, the one issue that prevents me most from helping my clients is the lack of insurance. If you have motorcycle insurance on your bike in NJ or PA your insurance company is REQUIRED to offer you underinsured and uninsured motorist coverage in the SAME amount that you purchased in liability coverage. The operative words here are "required" and the "same amount". This is for your protection! Don't be fooled by insurance company jargon. At first glance it seems unfair that you should have to buy more insurance because somebody who caused your motorcycle accident did not have enough … [Read more...]

Motorcycle Back Injury Settlement

The position we are in and the lack of protection we have when riding a motorcycle leaves us open to back trauma in the event of a motorcycle accident. As a leading Pennsylvania motorcycle accident lawyer I have worked with many clients in obtaining an equitable motorcycle back injury settlement, and I know the struggle that can ensue when you are in the process of recovering from a serious back injury suffered in a motorcycle accident. If a motorcycle crashes into a solid object, such as another vehicle or a guard rail, chances are the rider will be thrown a significant distance through the air and land awkwardly, damaging the spine through torsion (twisting) or contusion (a bruising blow). If the rider is not thrown, the back is often injured by being pinned between and crushed by … [Read more...]

Motorcycle Bodily Injury Settlements

I just settled a substantial six-figure case for a Pennsylvania motorcycle accident client, who sustained serious injuries to his leg, when he laid his bike down in order to avoid impact with a vehicle that pulled out from a stop sign into his path of travel.     Although most of my clients have been severely injured in a motorcycle accident, some, like this one, have far greater injuries than others.  The only reason this client’s motorcycle bodily injury settlement wasn’t for seven-figures was because he was retired and didn't have a wage-loss claim to put on the board.  Although he did have quite a substantial health insurance lien against his recovery which was boardable.   The Right Insurance Makes a Big Difference My motorcycle accident client was very fortunate to have had … [Read more...]
