This months column deals with a question that I am inevitably asked by every client at some point during their case and that is. “How much is my motorcycle accident case worth, and approximately how long will it take to resolve?”
The answers to these questions are linked because the length of the Pennsylvania motorcycle accident claim will be affected by the type of injuries, the amount that my client is seeking to recover and of course the amount that the other parties insurance company is willing to offer.
The question as to value is often asked early in the claim and as such, usually I am unable to give an estimate at that time, unless the injury and the treatment are obvious and objective in nature.
In other words … if I have a client who has suffered a fracture of his or her arm or leg that required surgery, I can usually give a relatively accurate estimate as to the value of that claim assuming that the injury goes on to heal without any major complications such as infection or a nonunion of the broken bones.
If either or these complications occur, then an estimate as to the value of that injury becomes more difficult, until I am able to assess the full extent of the injury.
Your Accident Insurance Plays a Major Role in the Worth of Your Case
It is also important to remember, that the recovery for any Pennsylvania motorcycle injury will be limited by the amount of available insurance coverage.
As discussed before, in most cases, regardless of the severity of the injury, you will only be able to recover the amount of insurance that is available to the person who caused your motorcycle injury plus any underinsured motorist coverage that you have purchased on your motorcycle or in the rare case, your automobiles.
I know there are some attorney’s out there that will give high estimates and/or promise large recoveries in order to insure that they sign up a client however, I will not give wild estimates or make promises that I can not keep simply to guarantee that a client will retain my office to represent them.
Fortunately, most cases do not require the filing of a motorcycle accident lawsuit, and depending upon the severity of the injury, a motorcycle accident settlement will resolve within approximately one year.
But, that assumes:
- the injuries are all known
- the treatment has been completed, and
- my office is in possession of all of the necessary documentation to prove the loss.
Once in possession of these proofs, as your Pennsylvania motorcycle accident lawyer, we forward this material to the insurance company as quickly as possible in order to obtain an expeditious resolution for your.
